Practical legal advice when a notice threatens your business, premises or activities

Act quickly to protect your position

If you have been served with a noise abatement notice, the consequences can be immediate and significant. The notice may restrict when or how you operate, require works to be carried out, or expose you to enforcement action if its requirements are not met. There is a strict 21 day deadline from the date of the service of the notice to appeal so early advice is essential.

Contact our crime and regulatory law solicitors as soon as possible. We can assess the notice, preserve the appeal deadline and advise on the best route to protect your interests.

How we can help

  • review the notice, supporting evidence and the council’s investigation
  • advise on the merits, risks, costs and commercial impact of an appeal
  • identify technical, procedural and evidential weaknesses
  • engage with the local authority to explore variation, withdrawal or an agreed solution
  • coordinate evidence from acoustic consultants and other experts
  • prepare and conduct an appeal before the magistrates’ court
  • advise on compliance and enforcement risk while the appeal is ongoing

Can a noise abatement notice be appealed?

A person served with an abatement notice under section 80 of the Environmental Protection Act 1990 may appeal to the magistrates’ court. The applicable grounds depend on the facts, but may include that the notice is not justified i.e. the problem does not qualify as a legal nuisance, contains a defect or error, imposes unnecessary or unreasonable requirements, allows insufficient time for compliance, or should have been served on someone else.

What happens next?

  1. Initial review: we examine the notice, service date, stated requirements and relevant background.
  2. Evidence and strategy: we identify the strongest grounds, obtain technical input where needed and advise whether negotiation or appeal is preferable.
  3. Protective action: where appropriate, we prepare and lodge the appeal within the applicable deadline.
  4. Resolution: we pursue withdrawal, variation, settlement or a court determination, keeping your operational priorities in view.

Noise abatement notice appeals FAQs

The deadline is usually 21 days from service of the notice. Do not wait: the correct calculation can depend on the notice and the circumstances of service, and preparation should begin promptly.

Not in every case. Whether the notice is suspended pending the appeal depends on the applicable rules and the nature of the notice. We will advise you on compliance and enforcement risk at the outset.

Often, yes. Early engagement, credible technical evidence and workable mitigation proposals may create scope for a notice to be withdrawn or varied, or for an agreed compliance plan. We will pursue a proportionate solution while protecting your appeal position.
