Practical legal advice when a notice threatens your business, premises or activities
If you have been served with a noise abatement notice, the consequences can be immediate and significant. The notice may restrict when or how you operate, require works to be carried out, or expose you to enforcement action if its requirements are not met. There is a strict 21 day deadline from the date of the service of the notice to appeal so early advice is essential.
Contact our crime and regulatory law solicitors as soon as possible. We can assess the notice, preserve the appeal deadline and advise on the best route to protect your interests.
A person served with an abatement notice under section 80 of the Environmental Protection Act 1990 may appeal to the magistrates’ court. The applicable grounds depend on the facts, but may include that the notice is not justified i.e. the problem does not qualify as a legal nuisance, contains a defect or error, imposes unnecessary or unreasonable requirements, allows insufficient time for compliance, or should have been served on someone else.
We advise businesses, developers, operators, landlords, property owners and individuals facing noise-related action, including matters involving hospitality venues, construction sites, industrial premises, entertainment, plant and machinery, deliveries and other commercial activities.
If you need help with a noise abatement notice appeal, compliance or regulatory matters, our specialist litigation lawyers can provide clear, practical advice tailored to your organisation.
