Stepparent adoption: formalising a modern family

Our family law team was instructed in a sensitive matter advising a stepparent who was considering adopting his stepchild. Stepparent adoption is an increasingly common aspect of modern family life as blended and reconstituted families become more prevalent. Stepparent adoption is a significant step, conferring full parental rights and responsibilities on the stepparent and providing legal permanence that reflects and formalises the lived reality of a modern-day family unit.

For context:

The client had married, and his wife had a child from a previous relationship. The child had never had a relationship with her biological father, and the client had effectively assumed the role of her father throughout her life. In fact, the child understood the client to be her father. Despite this, he had no parental responsibility or legal rights to the child, which created practical difficulties for them as a family in everyday life. For example, the family encountered issues when travelling abroad as they did not share a common surname. The client also lacked legal authority to make important decisions regarding the child. This position was particularly challenging for the family. The client, therefore, wished for the legal position to reflect the reality of the family circumstances and to legally formalise his relationship with the child.

What happened next?

Drawing on our experience within our modern family practice, we provided clear, strategic and comprehensive advice on the legal framework governing adoption in England and Wales, including procedural requirements and the significant long-term consequences of adoption. In particular, we advised on the permanent transfer of parental responsibility and the impact this would have on the client, and the legal effect of severing the child’s legal relationship with her biological father.

Exploring alternative legal options

As specialists in this area, we advised the client on alternative legal routes to adoption that could be considered to reflect the family’s circumstances within a legal framework.

We undertook a detailed comparison of other legal options, including:

  • Parental Responsibility Agreements
  • Parental Responsibility Orders
  • Child Arrangements Order
  • Special Guardianship Orders
  • Specific Issue Orders

We carefully explained their respective legal effects, advantages and limitations. This holistic approach enabled the client to properly assess the options available to him in his circumstances.

The outcome

Following this advice, the client was able to make a fully informed decision to pursue the course of action best suited to the child’s welfare and the family unit, while also fully understanding the impact upon him personally.
