Time limits (don’t delay)
In most medical negligence claims in England and Wales, you generally have three years from the date of negligence or the date of knowledge. Do I have a claim?
Not every stillbirth or neonatal death is caused by negligence. Potential failings can include (examples only):
- Missed or misinterpreted fetal monitoring (CTG/ultrasound)
- Delays escalating care during labour (e.g. abnormal heart rate, bleeding, shoulder dystocia, breech)
- failures to manage small for gestational age (SGA) babies and fetal growth restricted (FGR) babies
- Mismanaged pre-eclampsia or diabetes
- Issues with placenta or umbilical cord not appropriately acted upon
- Inadequate resuscitation at birth
- Maternal infection not recognised/treated promptly
