Time limits (don’t delay)

In most medical negligence claims in England and Wales, you generally have three years from the date of negligence or the date of knowledge. For parents bringing claims on behalf of a baby who has died, different rules can apply depending on the circumstances. Do I have a claim?

Not every stillbirth or neonatal death is caused by negligence. Potential failings can include (examples only):

  • Missed or misinterpreted fetal monitoring (CTG/ultrasound)
  • Delays escalating care during labour (e.g. abnormal heart rate, bleeding, shoulder dystocia, breech)
  • failures to manage small for gestational age (SGA) babies and fetal growth restricted (FGR) babies
  • Mismanaged pre-eclampsia or diabetes
  • Issues with placenta or umbilical cord not appropriately acted upon
  • Inadequate resuscitation at birth
  • Maternal infection not recognised/treated promptly
